Men entered on NCS Engagements for Preparation and Maintenance of Minefields
At the Court at Buckingham Palace, the 29th day of July, 1937.

Present, The King's Most Excellent Majesty in Council.

Whereas there was this day read at the Board a Memorial from the Right Honourable the Lords Commissioners of the Admiralty, dated the 22nd day of July, 1937 (N. 4881/37), in the words following, viz.:-

Whereas by Section 3 of the Naval and Marine Pay and Pensions Act, 1865, it is enacted inter alia that all pay, pensions or other allowances in the nature thereof payable in respect of services in Your Majesty's Naval or Marine Force to a person being or having been an Officer, Seaman or Marine therein shall be paid in such manner and subject to such restrictions, conditions and provisions as are from time to time directed by Order in Council:

And whereas it has become necessary to enter men to serve in Your Majesty's Navy under Non-continuous service engagements for the special duties of preparation and maintenance of controlled minefields and kindred devices under such conditions as to make the existing scales of pay and allowances inappropriate:

And whereas we are of opinion that, provided they are otherwise eligible, men who may be entered to serve for the special duties above mentioned should count the time as Continuous Service time for Naval Pension and Good Conduct Medal Gratuity as if they had re-engaged in the General Service to complete time for pension; and that this condition should apply also to all men whose First Continuous Service engagement having expired, re-entered, or re-engaged for Non-continuous Service under certain emergency and expansion schemes:

We beg leave humbly to recommend that Your Majesty may be graciously pleased by Your Order in Council:-

  1. To sanction the institution of the subjoined rates of pay and conditions, to be applicable to naval ratings who are entered for special duties connected with controlled minefields:-

    The above rates to include progressive pay, non-substantive pay and pay for good conduct badges:

    For men who are otherwise eligible, time served to count as Continuous Service time for Naval Pension and Good Conduct Medal Gratuity purposes.

  3. To sanction the application of the above condition regarding non-effective benefits to all men whose First Continuous Service engagement having expired, re-entered or re-engaged for Non-continuous Service under the aforesaid emergency and expansion schemes.

The Lords Commissioners of Your Majesty's Treasury have signified their concurrence in these proposals.

His Majesty, having taken the said Memorial into consideration, was pleased, by and with the advice of His Privy Council, to approve of what is therein proposed.

And the Right Honourable the Lords Commissioners of the Admiralty are to give the necessary directions herein accordingly.

Controlled Minefields - Additional Allowance

Present, The King's Most Excellent Majesty in Council.

Whereas there was this day read at the Board a Memorial from the Right Honourable the Lords Commissioners of the Admiralty, dated the 24th day of April, 1940 (N. 7491 /40), in the words following, viz.:-

Whereas by Section 3 of the Naval and Marine Pay and Pensions Act, 1865, it is enacted inter alia that all pay, pensions or other allowances in the nature thereof payable in respect of services in Your Majesty's Naval or Marine Force to a person being or having been an Officer, Seaman or Marine therein shall be paid in such manner and subject to such restrictions, conditions and provisions as are from time to time directed by Order in Council:

And whereas by Order in Council bearing the date 29th July, 1937, special conditions of service and of pay were instituted for naval ratings entered for special duties connected with controlled minefields and kindred work:

And whereas there has now arisen the need for employing ratings in the capacity of Leading Seaman and of Chief Electrical Artificer in the controlled minefields service:

We beg leave humbly to recommend .that Your Majesty, by Your Order in Council, may be graciously pleased to sanction the undermentioned special rates of pay, namely:

Leading Seaman

3d.

a day.

Chief Electrical Artificer

12s.

3d.

a day.

The conditions of service and of pay of such ratings to conform to the conditions laid down for other ratings employed on the special duties referred to above.

The Lords Commissioners of Your Majesty's Treasury have signified their concurrence in the above proposal.

His Majesty, having taken the said Memorial into consideration, was pleased, by and with the advice of His Privy Council, to approve of what is therein proposed.
